GENERAL FUNCTION

The Deputy Compliance Officer assists the General Counsel & Chief Compliance Officer in ensuring that the University maintains compliance with all applicable laws and regulations (including, without limitation, Executive Order 11246, Title VI and Title VII of the Civil Rights Act of 1964, Title IX of the Educational Amendments of 1972; the Civil Rights Act of 1991, the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990 (“ADA”), Age Discrimination in Employment Act of 1967 as amended (“ADEA”), the Family Educational Rights and Privacy Act (“FERPA”), and the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)). The Deputy Compliance Officer serves as a liaison between the General Counsel, the Director of the Office of Institutional Equity and Compliance, and the Director of Human Resources, in terms of monitoring, recommending, and implementing policies and procedures regarding the University’s regulatory compliance obligations. The Deputy Compliance Officer also serves as the ADA Coordinator for the University system and, in that capacity, supervises the Disability Resource Center.

MINIMUM ACCEPTABLE QUALIFICATIONS

Education: A Bachelor's degree is required, preferably in Human Resources Management or a related field. A Master’s degree in Human Resources Management or a related field is strongly preferred.

Experience: At least three (3) years of employment in an affirmative action/equal opportunity/compliance management position is required. Affirmative Action/Equal Opportunity, Title IX Compliance, and Disability Compliance experience in higher education is preferred. Knowledge of government agencies and their regulations, at a policy level, as well as thorough knowledge of Title VI, Title VII, Title IX, Section 504, and the ADA are required. Knowledge of discrimination experienced by specific protected classes, as identified by federal and state enforcement agencies, is required. Experience in presenting training programs and workshops on compliance topics is required.

Skills: Demonstrated ability to design, develop, and implement programs and services in response to regulatory compliance needs is required. Effective oral, written and interpersonal communication skills and strong quantitative skills are required. Computer competency, particularly in the use of computerized applicant and employee databases and similar computer applications, is required. A demonstrated knowledge and understanding of multicultural and diversity issues is required.

ESSENTIAL DUTIES AND RESPONSIBILITIES

1. Works closely with the General Counsel & Chief Compliance Officer, the Director of the Office of Institutional Equity and Compliance, and the Director of Human Resources to ensure that the University is compliant with its various regulatory compliance obligations.

2. Serving as the University’s system-wide ADA Coordinator, ensures the University's compliance with all applicable laws and regulations regarding services for persons with disabilities by receiving and assessing requests for the provision of reasonable accommodations for faculty and staff; supervising the Disability Resource Center and overseeing the student disability accommodations process; provides training on accessibility and disability rights and discrimination; and recommending appropriate solutions and advising senior administrators on topics such as disability rights and issues, attitudes regarding persons with disabilities, reasonable accommodations, technology, facility access, and other barriers.

3. Ensures the University's compliance with all applicable laws and regulations regarding the free exercise of religion by receiving and assessing faculty, staff, and student requests for the provision of religious accommodations.

4. Ensures the University's compliance with all applicable laws and regulations regarding pregnant and parenting individuals by receiving and assessing faculty, staff, and student requests for the provision of pregnancy and/or parenting accommodations.

5. Assists the General Counsel & Chief Compliance Officer in ensuring that the University is compliant with its FERPA and HIPAA obligations through the implementation of policies and procedures, provision of training, and investigation of complaints alleging violation by University personnel of these federal statutes.

6. Remains current as to developments in regulatory compliance obligations impacting the University system, and provides essential training regarding same to University administrators, supervisors, and other employees as appropriate, by designing, developing, scheduling, and conducting specific workshops and in-service training sessions.

7. Ensures that University policies and procedures are compliant with current regulatory obligations and prepares and recommends revisions to same when appropriate.

8. Develops a network of informed representatives of the University community which promotes an awareness and understanding of the University's commitment, activities, and efforts regarding accessibility and universal design through avenues including by chairing the President’s Council on Accessibility, and chairing and/or serving on other committees as assigned (e.g., BIT, ERM), providing education and training to designated University employees, and other appropriate approaches.

9. Facilitates a work environment that encourages knowledge of, respect for, and development of skills to engage with those of other cultures or backgrounds.

10. Remains competent and current through self-directed professional reading, developing professional contacts with colleagues, attending professional development courses, and attending training and/or courses as required by the General Counsel & Chief Compliance Officer.

11. Contributes to the overall success of the University by performing all other duties and responsibilities as assigned.

SUPERVISION

The Deputy Compliance Officer reports to and receives administrative supervision from the General Counsel & Chief Compliance officer, and functions independently within the guidelines of the University's personnel policies and regulations, coordinates with all appropriate unit heads, and exercises considerable judgment and initiative in planning, organizing, and completing assignments. The Deputy Compliance Officer supervises the Disability Resource Center. .
