Mitigation of Harmful Effects
Applies to the Administrative Requirements of the Health Insurance Portability and Accountability Act of 1996. 45 CFR Section 164.530(f)
The Employee Benefit Plan mitigates, to the extent practicable, any known harmful effect of a use or disclosure of PHI due to either its own violation of the privacy rule or due to a violation of the privacy rule by its business associate.
